2 – Personal Data We Process

We may request specific personal data about you to add you to our email list and/or fulfill your requests for information. You may choose not to provide your personal data, but then you might not be able to receive information from us. • Information you provide such as survey data, feedback, comments, or other

3 – Why We Process Personal Data, and Our Legal Bases for Processing

We initially process your personal data to respond to your requests for information, and to add you to our emailing list. When we process your personal data for these purposes, we do so with your consent. If you decide to invest in our company, we will process your personal data as necessary to:

  • Take steps, at your request, before entering into a contract with you.
  • Perform a contract with you.
  • Comply with legal obligations to which we are subject.

4 – Do We Share Your Personal Data?

We will not share your personal data except: (a) for the purposes for which you provided it; (b) with your consent; (c) as may be required by law or as we think necessary to protect our company or others from injury (e.g., in response to a court order or subpoena, in response to a law enforcement agency request, or when we believe that someone is causing, or is about to cause, injury to or interference with the rights or property of another); or (d) on a confidential basis with persons or organizations with whom we contract to carry out internal operations. We may transfer your personal data to our successor-in-interest in the event of an acquisition, sale, merger or bankruptcy.

5 – How Do We Store Your Personal Data

After receiving your personal data, we will store it on our systems for future use. We will store your personal data on servers located in the United States. Unfortunately, no data transmission over the Internet or data storage solution can ever be completely secure. As a result, <although we take industry-standard steps to protect your information (e.g., strong encryption),> we cannot guarantee or warrant the security of any information you transmit to or receive from us or that we store on <our or our service providers’> systems.

We may store your personal data until you ask us to remove it from our servers (or longer if permitted or required by law). However, unless agreed with you in a separate writing, we reserve the right to discard any data that we hold at any time.

6 – How Can You Access and Control Your Personal Data?

If you are located in Europe, you have the right—on request and free of charge—to:

  • access and obtain a copy of the personal data we hold about you;
  • obtain information about the purposes for which we process your personal data and the categories of personal data concerned;
  • obtain information on the recipients or categories of recipients to whom your personal data has been or will be disclosed;
  • transfer your personal data from us to another data controller;
  • in certain circumstances, erase all personal data we hold about you;
  • lodge a complaint to the Supervisory Authority in your jurisdiction regarding our processing of your personal data; and
  • withdraw your consent to our collection, use, storage, and dissemination of your personal data at any time.

You may exercise these rights and choices by sending an email message to privacy@faction.co with “GDPR Request” in the subject line.

Any request to withdraw consent will not affect the lawfulness of our collection, transfer, and other processing of your personal data before you withdrew consent, or under alternative methods of lawful processing.

7 – Children and Young People’s Information

We do not knowingly collect or accept any information from minors, and we comply with all applicable privacy laws including the GDPR and the U.S. Children’s Online Privacy Protection Act (“COPPA”).
